Session 3: The Future of Open Banking Description: At long last, in late 2023 the CFPB issued a proposed rule to implement Section 1033 of the Dodd-Frank Act’s requirement that financial services providers make account information in those providers’ control freely available to consumers, and representatives acting on their behalf. The CFPB has also signaled that it will adopt criteria for organizations to become officially recognized as standard setters under the rule. Session 6: Third Party Oversight - No One’s Exempt Description: In this session we will discuss third party oversight and how it impacts both Banks and FinTechs. Together, we will consider how oversight is not just due diligence to make sure the third party you are working with is acceptable, but also ensuring that we all pay attention to what the third party’s business and risk model is and how they fit into a Bank’s risk model. Attendees will learn what third party oversight encompasses, the risks that come with third-party relationships, the requirements tied to oversight, and how the recent joint guidance from the FDIC, FRB, and OCC impacts how Banks and FinTechs should be thinking about third-party relationships and oversight going forward. Session 7: Artificial Intelligence Description: K.C. Halm will discuss emerging regulatory and legal trends surrounding the use of AI in the payments and financial services industry. As federal, state and local legislators, regulators and administrators increase their focus on the use of AI-enabled tools and applications, the number of new rules and regulations is rising exponentially. From notice, consent, opt-out and audit obligations, the list of potential new duties for entities operating in this space is not insignificant. K.C. will discuss the leading proposals and developments in this area, the potential legal and regulatory risks of operating in this environment, and strategies for mitigating such risks.
